Client provides all necessary materials upfront, including reference materials or assets, before work begins

Client warrants that the character designs, reference material, and other intellectual property provided to the artist is legally obtained and are authorized for use by the client

Artist strives to the best of her ability and that the work done is 100% original to the artists best knowledge

Artist may use comercially liscenced, copyright-free and/or educational tools/materials

Artist reserved the right to refuse commissions based on subject matter, time constraints or other reasons

Artist promises to keep client updated through every milestone and up to the delivery, notifying the client of any delays that may impede the ability to complete a commission on it's original due date

Artist will not start any work until the required down payment is paid by the client

Artist defines scope of work, features, price, deliverables, and other details for the project in a proposal format according to Artist discretion, which may include private message through X, Discord, Instagram, Google document, and/or electronic bank invoice. The details set forth by the Artist shall be agreed upon by the Client before work begins.

Specific restrictions include but are not limited to; Pedophilic or Loli/Shotacon content, Zoophilic content including Feral pornography, ABDL or any diaper based fetish, Depictions of Rape (even consensual non consensual scenes), Abuse and cruelty of animals or children, Heavy mech or armor, and sexual gore

Expectations to the restrictions are on a case by case basis (except Pedophilic, Zoophilic and Diaper Fetish content). Among the exceptions are violence and gore relevant to the Work’s story but not as the main focus; suggestive content (i.e. soft NSFW); and/or controversial subjects written for satire or tragedy.

Artist does not create Work for the end purpose of Non-Fungible Tokens (NFTs) nor for Artificial Intelligence or Machine learning programs; nor does the Artist offer her services for Work for Hire agreements nor will she sign any Non-Disclosure Agreement (NDA) for the purpose of the Work.

Client can discuss further with Artist to discuss any restrictions not listed prior to commissioning

All projects require 7 days minimum and may take up to several months depending on the works complexity. Timeline depends on commission type, complexity and work load

The agreed upon turnaround time (i.e. Deadline) is specified in the contract laid out by the Artist, However if a shorter turn around is required by the Client, the Artist and Client can discuss this to find a middle ground before the down payment is sent

Artist provides progress updates and seeks Client feedback voluntarily during Review stages.

Final deliverables (i.e. all items consisting of the full Work as itemised in the invoice and/or contract) are provided by the Artist through either email, Discord, Google Drive, or other file transfer platforms.

If there are any delays and adjustments to the timeline the Artist will inform the Client and may provide a Deadline Extension to complete the Work.

The Client acknowledges that the Work is digital in nature and that they will not receive any physical form of the Work from the Artist.

Client is free to reach out to Artist at any time to inquire about Commission

Communication will naturally occur during the process, through the project, this may include idea generation, collaboration, situational updates and more

Communication may happen through Discord, X, Email, or other messaging sites

Response time may vary on Artists behalf, Artists currently works from 4pm - 9pm central on Monday through Friday so please allow Artist enough time to respond.

Smaller commissions are allowed two revisons during the work progress, and larger commissions are allowed four

The revision privileges are revoked once all deliverables are sent to the client

Additional charges may apply for additional revisions exceeding the standard number and / or if the Client inquires about revisions after final products have been sent. See Payments and Other fee's below

The Artist retains copyright, ownership, redistribution, and intellectual property rights of the Work, which includes but is not limited to display, advertising, printing the Work and work in progress version on websites, social media, portfolios, and more.

For Character work, The Artist retains the rights to the design until all payments have been made and deliverables have been sent to the Client

For Work that is collaborative (i.e. comic script or short story written by Client) the written story is still owned by the Client.

All rights not explicitly listed here shall be reserved by the Artist. The Artist retains the ownership and copyright of the Work in all its conceptual and finished versions, unless specified otherwise in writing.

Clients receive exclusive, non-transferable usage rights to the Work for personal use (i.e. non-profit purposes). Refer to Section 6.

Personal use means usage of Work for displaying on social media accounts for promotional purposes, such as profile pictures, banners, and posts; printing and framing in personal spaces; displaying on personal websites and channels, excluding profiting from the Work of any kind in these websites or channels.

Client must not claim Work as their own and must credit Artist using her social tag/username/link at every instance of display of the Work or permanently on their websites, social media profiles, portfolios, and so on.

Client must not edit or modify Work in any way without prior permission from the Artist.

Client can sell the Character rights inherited by purchasing a design, it is encouraged that the Client sells the design at original price unless more art has been purchased/made for the character

Client can gift, trade or alter character designs 3 days after purchasing an adopt or custom

Character designs / Adopts purchased by the Client are for personal use only, see commercial rights for more

Commercial rights means usage of Work in subscription or ad-revenue websites, streams, videos and other content, or any monetized instances, or selling or reselling Work to another party, as a part of any product, or on another platform.

Commercial usage rights are not included unless specified in a separate written contract and itemised in the Work’s invoice.

In the case of design work for the definition of the Client's brand identity such as character design, logo design, and more, intellectual property rights of the designs and their likeness are exclusively granted to the Client for use, production and modification purposes, commercial or personal use.

Usage of Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFT; block-chain; or other for-profit platforms/purposes, is strictly prohibited.

Additional charges will be required for commercial usage if not included, typically a flat rate or twice the original cost depending on the complexity of the Work’s items & usage.

Artist’s rates are in USD($) and paid through Cashapp, Kofi or other methods as instructed by the Artist.

Client pays the Full Balance specified by the Artist in her invoice unless specified otherwise.

For halved or scheduled payments, the Client pays 50% of the Full Balance upfront and the remaining amount is due before the Artist delivers the Full Work and no later.

Artist will send the invoice to the Client when she is ready to begin work. Clients must not send money before these requests for payment from the Artist.

For upfront payments, invoices must be paid within a full seven-day week or the project may be cancelled. The Client must notify of any delays in their end of payment to avoid complications and so that the Artist can make adjustments if necessary.

Artist’s rates may change depending on the Work’s complexity, requirements, or additional requests.

Client may be subject to any of the fees below for reasons indicated.

Kofi fee is for payments made through Kofi and into paypal to make up for the taxes taken out of the original price. ($5 USD)

Out of Scope fee is for when the Artist is forced to do work that is either unrelated or more than what’s required for the Work. A basic rule would be if the item or service is not listed in the Work invoice and/or contract then it is automatically out of scope. (Cost Debatable)

Additional Revision fee is charged per round for every extra revision the Client requests. ($10 USD per revision)

Client acknowledges the Work and all deliverables itemised in the invoice or in the contract if provided are digital in nature; there is no physical artwork to be received from the Artist.

Client warrants they will not issue chargebacks and the refund policy mentioned below will be followed.

If the Artist cannot complete the Work for any reason then the Client may be eligible for a partial to full refund. If work done up to this point is accepted and used by the Client, the Artist will provide a partial refund only.

Upon the Client’s request to cancel the Work agreement the refund amount will be based on either of the following situations:

If the Client wants to cancel before the Artist sends the first round of sketches, they will be refunded 60% of the paid Full Balance.

If the Client wants to cancel at a point in time after the Artist sent the first round of sketches, they will receive a refund of 40% of the paid Full Balance.

In the case of partial payment of the Full Balance (i.e. scheduled or halved), the refund amount will be calculated on the amount that was initially paid.

No refunds are possible for any of the following reasons:

Upon payment of the invoice unless the Artist initiates it

After the Artist delivers the full Work to the Client

If the Work and any of its items are not used by the Client as intended

In the event of a refund, the Client cannot request a refund chargeback to the Artist. The Artist will transfer the refund amount to the Client.

The Artist and Client acknowledges that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information) outside of the development of Work, that will not be visible to the public, shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.

Client indemnifies Artist against claims, losses, damages, and expenses related to Work usage by the Client, breach by the Client of the Agreement, or third-party claims.

If Client's rights are violated or the Work is not delivered as agreed, Artist will work to remedy the situation first.

Client is majority of age (18 and above) and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.

Work agreement date is upon first inquiry/communication or first transaction.
